Terms of Use
Last updated · 18 May 2026By using this website, you agree to these Terms of Use. If you do not agree, please do not use the website.
1. Purpose of the Website
This website presents The Games Project, including:
- project information and public updates
- selected public-safe aggregate metrics
- partner information
- embedded videos and livestreams
- educational content
- behind-the-scenes content
- related project communication
The content is provided for information, education, documentation, and entertainment.
2. No Affiliation With CrossFit
The Games Project is independent.
CrossFit® and CrossFit Games® are trademarks of CrossFit, LLC. The Games Project is not owned, operated, endorsed, sponsored by, or otherwise legally affiliated with CrossFit, LLC or the CrossFit Games®.
Any references to CrossFit or the CrossFit Games® are used only to describe the sport, the competitive pathway, and the public athletic goal of the project.
3. No Medical or Personal Training Advice
The content on this website is not medical advice, diagnostic advice, injury-risk prediction, readiness prediction, or personalised training advice.
The project may discuss training, recovery, nutrition, performance, testing, wearables, mobility, data, and sport science. This content is shared as part of a public case-study and storytelling process.
Do not copy training, testing, nutrition, recovery, or competition strategies from this project without adapting them to your own situation and, where appropriate, consulting qualified professionals.
4. Live Tracker and Public Metrics
The live tracker shows selected public-safe aggregate project metrics, served via Cloudflare R2 as a static data file.
These metrics may be delayed, incomplete, manually reviewed, estimated, or updated over time. They are provided to document the project publicly, not to provide medical analysis, readiness prediction, performance guarantees, or a complete training record.
We do not guarantee that all metrics are complete, current, or free from errors.
Because The Games Project is an n=1 case study, aggregated data is not automatically anonymous. Public tracker data should be understood as curated public project communication.
5. Livestreams
Livestreams may show training, testing, competition preparation, project updates, or other public-facing content.
Any live metrics shown during a livestream, such as heart rate or training-session context, are intentionally broadcast public data. They should not be interpreted as medical data, diagnostic information, readiness prediction, injury-risk assessment, or a complete picture of athlete health.
Livestreams may be delayed, interrupted, changed, or removed at any time.
6. Embedded YouTube Videos
This website embeds videos hosted by YouTube (Google LLC). Embedded videos are loaded only after you actively click to play them.
By choosing to play a YouTube video on this website, you acknowledge that YouTube's terms of service and Google's privacy policy govern that interaction. YouTube is a third-party service over which we have no control.
7. Content Accuracy
We aim to publish accurate, honest, and useful information. However, sport performance is complex, data may be incomplete, and interpretations can change over time.
We do not guarantee that all content is complete, current, error-free, or suitable for your personal situation.
8. Intellectual Property
Unless otherwise stated, all text, images, videos, graphics, logos, designs, layouts, data visualisations, and other materials on this website are owned by The Games Project, based.athletics by Spengler, WOD-Science, partners, creators, or other stated rights holders.
You may not copy, reproduce, modify, publish, distribute, sell, or commercially use website content without prior written permission, unless permitted by applicable law.
You may share public website links in a normal, non-misleading way.
9. External Links and Embedded Services
This website may link to or embed third-party services, including YouTube, social media platforms, partner websites, livestream platforms, or other external tools.
We are not responsible for the content, availability, privacy practices, security, or terms of third-party websites or services.
10. Partnerships and Sponsored Content
The Games Project may work with selected partners and sponsors.
Partner products or services may appear in content where they are genuinely used, relevant to the project, or part of the project environment.
Partnerships do not guarantee positive coverage, scientific conclusions, performance outcomes, qualification outcomes, or specific results.
Scientific and educational content is kept clearly separated from purely promotional claims.
11. Acceptable Use
You agree not to:
- misuse the website or interfere with its operation
- attempt unauthorised access to any part of the website or its infrastructure
- scrape or extract data at scale without prior written permission
- reproduce or distribute public tracker metrics in misleading or deceptive contexts
- impersonate The Games Project, based.athletics by Spengler, WOD-Science, partners, or athletes

12. Availability and Changes
We may update, change, suspend, or remove parts of the website, live tracker, livestreams, content, partner pages, or public metrics at any time.
We do not guarantee uninterrupted website availability. The website and live tracker depend on third-party infrastructure, including Cloudflare, which may have its own scheduled maintenance or disruptions.
13. Limitation of Liability
To the extent permitted by law, we are not liable for damages arising from:
- use or non-use of this website
- reliance on published content, public tracker data, or live metrics
- training, recovery, nutrition, or performance decisions made by visitors

- third-party services, including Cloudflare or YouTube
- external links or embedded content

Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Governing Law
These Terms are governed by Swiss law, subject to any mandatory consumer protection or data protection rules that may apply in a visitor's country of residence.
Any disputes shall be subject to the jurisdiction of the competent courts at the registered seat of based.athletics by Spengler in Baar, Switzerland, unless mandatory law provides otherwise.
15. Changes to These Terms
We may update these Terms of Use when the website, live tracker, livestream setup, content model, partner structure, or legal requirements change.
